Employer’s inexcusable fault

Employer's inexcusable fault cover is a workplace-accident top-up that protects the company if it is held liable for failing its duty of care toward an employee.

Beyond Social Security's flat indemnity, an injured employee may bring an inexcusable-fault action if they believe the employer knew or should have known the danger and failed to take necessary measures. That action can lead to significant additional compensation, borne by the employer if the company is not covered.

Transport and construction both have high workplace-accident rates — driving, handling, working at height, heavy plant — which makes this cover especially relevant, even though it remains optional.

McLer assesses each client's real risk profile by activity to size this cover, rather than applying a generic limit.
